Patenting activity in the third world -- a case study of biotechnology patents filed in India

Abstract

Biotechnology patents filed in India during 1972-90 were analysed. Foreign patenting has dominated the scene with USA emerging as first among the foreign patentees followed by Japan and Germany. Multi-nationals have a major share in these patents. The emphasis of both developed and developing countries has been on pharmaceuticals. The quality of all the patents filed in India based on citation counts was found to be poor. From the domestic patent counts the general inventiveness of India was studied. The study corroborates the conclusions of earlier studies in respect of the Third World; that is, most patents in developing countries are held by foreign patentees, and these too by multi-national companies, and these developing countries are technologically less inventive.
