The impediments to technology transfer from the higher education sector. The education and training requirements for their removal

Abstract

The history of efforts to encourage technology transfer from universities in the U.S.A. are reviewed. The damaging effect which government policy of claiming the intellectual property rights of all inventions which had been fully or partly funded by state finance is described. The Patent and Trademark Law Amendment Act (PL96-517) of 1980 reversed this policy, allowing universities to retain the rights of their inventions. This has given a major impetus to technology transfer. Other impediments to transfer of technology, such as university or company policies, the not-invented-here attitude of companies and the 'ivory tower' aloofness of some universities are discussed and the importance of negotiation of adequate protection of intellectual property rights in drawing up contracts between university and industry is emphasized.
