Normas legales para la protección de los trabajadores migrantes

Abstract

El presente artículo ofrece una síntesis de los instrumentos y normas internacionales pertinentes que protegen los derechos de los trabajadores migrantes, tanto en el plano universal como regional. En el campo del derecho internacional, los derechos de los trabajadores migrantes emanan de varias fuentes. Hay varios tratados cuyas disposiciones son aplicables a todos los seres humanos, y por lo tanto también a los trabajadores migrantes, y otras que están específicamente destinadas a ellos con prescindencia de su situación legal o duración de la permanencia. Además, muchos de los derechos aplicables son parte del derecho consuetudinario, y todos los Estados deben observarlos. Por lo tanto, el desafío principal del régimen internacional de derechos humanos es asegurar su observancia por parte de los Estados. Deben tomarse medidas para promover el respeto efectivo de los derechos de los trabajadores migrantes, y se proponen medidas concretas para conseguirlo.
