Selbstverpflichtungen und Klimaschutz: wenig Spielraum im Rahmen geplanter Gesetzesinitiativen

Abstract

Im Rahmen der Debatte um eine wirksame nationale Klimaschutzpolitik hat die deutsche Wirtschaft wiederholt als Alternative zur geplanten CO2-/Energiesteuer und zur Wärmenutzungsverordnung angeboten, mit Selbstverpflichtungen zur Minderung der energiebedingten CO2-Emissionen beizutragen. Eine generelle oder auch nur teilweise Befreiung der Industrie von dieser Steuer oder der Wärmenutzungsverordnung im Tausch gegen Selbstverpflichtungen einzelner Unternehmen oder Unternehmensverbände ist jedoch rechtlich nur sehr eingeschränkt zulässig, administrativ schwer zu handhaben und umweltpolitisch bedenklich. Auch aus ökonomischer Sicht weisen Selbstverpflichtungen gegenüber alternativen umweltökonomischen Instrumenten wie der CO2-/Energiesteuer und der Wärmenutzungsverordnung keine überzeugenden Vorteile auf.
