Die innerstaatliche Umsetzung des Stabilitäts- und Wachstumspakts in Deutschland und Österreich

Abstract

The domestic implementation of the European stability and growth pact in the finance constitution was made in Austria with the inner-Austrian stability pact both more quickly and institutionally more obligatorily than in Germany. The Austrian stability pact was discussed at the end of 1998 and came into force on 15 January 1999, while the implementation in Germany occured three years later in a session of the financial planning advice on 21 March 2002. Furthermore, the recommendations of the financial planning advice are voluntary and not recoverable and do not represent any credible sanction scenery for the actors of the German financial policy. On the other hand, the Austrian stability pact was adopted as a formal law and as a state contract between federal government countries and municipalities and it leads, in the case of non-compliance, to concrete sanctions. These may include a fine on regional authorities in relation to the transgression in their deficit rates. Die innerstaatliche Umsetzung des europäischen Stabilitäts- und Wachstumspaktes in der Finanzverfassung ist in Österreich mit dem innerösterreichischen Stabilitätspakt sowohl schneller als auch institutionell verbindlicher als in Deutschland geregelt worden. Der österreichische Stabilitätspakt wurde Ende 1998 verhandelt und trat am 15. Januar 1999 in Kraft, während die innerstaatliche Umsetzung in Deutschland über drei Jahre später auf einer Sitzung des Finanzplanungsrates am 21. März 2002 erfolgte. Zudem sind die vom Finanzplanungsrat ausgesprochenen Empfehlungen freiwilliger und nicht einklagbarer Natur und stellen damit keine glaubwürdige Sanktionskulisse für die Akteure der deutschen Finanzpolitik dar. Der österreichische Stabilitätspakt ist hingegen als formelles Gesetz und damit quasi als Staatsvertrag zwischen Bund, Ländern und Gemeinden verabschiedet worden und führt bei Nichteinhaltung auch zu konkreten Folgen bis hin zur Aufteilung einer eventuellen Geldbuße auf die Gebietskörperschaften im Verhältnis der Überschreitung ihrer Defizitquoten.
