Acţiunea În Tăgada Paternităţii În Lumina Efectelor Deciziei Curţii Constituţionale Şi A Jurisprudenţei Curţii Europene A Drepturilor Omului

Abstract

TLa Cour constitutionnelle conclut que la réglementation par les dispositions de l'art. 54, al. 2 C.fam. le droit d'intenter une action en faveur que de nier la paternité présumée présomption père, la mère et l'enfant hors né pendant le mariage, également titulaire d'un intérêt légitime à promouvoir de telles actions constituent une violation du principe d'égalité inscrit Art. 16, al. 1 de la Constitution. Ce qui prédomine dans ce contexte est la raison commune qui est d'assurer la prévalence de la réalité sur la fiction, peu importe les motifs particuliers ou des justifications sur les deux acteurs, père présumé que la mère et l'enfant qui ne peut se prévaloir des intérêts particuliers peut conduire à la détention comme un argument pour justifier impérative système discriminatoire de la loi établie par la critique.
