Consideraţii Teoretice Asupra Dispoziţiilor Legii Nr. 469/2002 Privind Unele Măsuri Pentru Întărirea Disciplinei Contractuale

Abstract

La présente étude se propose une analyse des principaux aspects de la Loi n°. 469 du 9 juillet 2002 concernant certaines mesures en vue de renforcer la discipline contractuelle. En essence, on va montrer, entre autres, que cette loi s’applique à tous les contrats conclus pour réaliser des actes de commerce par des agents économiques commerçants, personnes juridiques et, commerçants, personnes privées. Tel que le titre le suggère, la loi vise l’implémentation de mesures pour renforcer la discipline contractuelle en matière commerciale. Par la promotion de cette loi, on a essayé de résoudre certains problèmes urgents avec lesquels les agents économiques sont confrontés, problèmes déterminés spécialement par le manque de discipline dans les rapports d’affaires et contractuels, qui ont généré et le font encore, des mauvais fonctionnements dans l’économie réelle. L’évaluation de l’influence concrète des mesures proposées par la loi sera visible dans le temps, lorsque l’on pourra apprécier si l’acte normatif a atteint le but proposé.
