Procedura Somaţiei De Plată În Materie Comercială. Unele Aspecte Teoretice Şi Practice (Iii)

Abstract

La législation de Roumanie permet à présent la possibilité d’obtenir, dans un délai relativement court, un titre exécutoire absolument nécessaire au créditeur pour pouvoir passer à l’exécution par huissier du débiteur et, pour finalement réaliser la créance contre lui. Cette facilité s’étend aussi sur la procédure en vue d’obtenir le titre exécutoire. Ainsi, nous nous sommes proposés dans cette étude, au long de plusieurs de ses chapitres, d’examiner certains aspects théoriques, mais aussi pratiques, de la sommation de payer. Dans ce sens, on a procédé à l’analyse détaillée de la procédure judiciaire de la Section commerciale et de contentieux administratif du Tribunal de Cluj, largement exemplifiée dans le matériel.
