De L'Histoire Du Droit Français: Jean Domat (1625 – 1696)

Abstract

Jean Domat a été considéré l'un des plus grands juristes français du XVIIème siècle. Il a étudié le droit à l'Université de Bourges, et, après avoir obtenu son doctorat, il a exercé la profession d'avocat. Son influence a été profonde surtout au XVIIIème siècle. L'oeuvre qui l'a rendu célèbre est «Les Lois civiles dans leur ordre naturel» (Paris, 1689 R 1694, 3 volumes, in-4°). D'autres ouvrages importants, publiés après sa mort, sont «Le Droit public» (Paris, 1697, 2 volumes, in-4°) et «Legum delectus ex libris Digestorum et Codicis» (Paris, 1700, in-4°).Ses écrits ont eu de nombreuses éditions et ils ont été traduits en anglais aussi. Il est resté dans l'histoire du droit français par la profondeur de sa pensée et par l'esprit philosophique qui l'a animé. Il a été apprécié comme «le jurisconsulte-philosophe par excellence», «le restaurateur de la raison dans la jurisprudence». Mais son plus grand mérite réside dans l'effort de réaliser l'unité du droit.
