Политики И Процедури За Предварителен Контрол За Законосъобразност

Abstract

Предварителният контрол за законосъобразност е част от въведените контролни дейности, задължителни за прилагане в публичния сектор още от 2000 г., като през годините е претърпял промени във философията на прилагането си. Последните изменения на законовите разпоредби от 2019 г. поставят изискване пред ръководителите от публичния сектор да въведат политики и процедури за предварителен контрол за законосъобразност. Тези политики и процедури следва да са основани на няколко стълба. От една страна, осъществяването на предварителен контрол за законосъобразност е необходимо да е съгласно издадените от Министъра на финансите указания за реда и начина на осъществяване на предварителен контрол за законосъобразност. От друга, следва да е базирано на оценката на риска в организацията. И не на последно място политиките и процедурите се изисква да съблюдават цената на контрола въз основата на анализа разходи–ползи.
