Проблеми При Дефинирането На Същността И Правната Рамка На Публично-Частното Партньорство В България

Abstract

Публично-частните партньорства (ПЧП) са част от общата промяна в дейността на общините и търсенето на нови форми на управление. Неоспорим факт е, че последните десетилетия са съпътствани с утвърждаването на това партньорство в страните, трансформирали се от планови в пазарно ориентирани икономики. В статията са разгледани мненията на отделни автори и институции, изследващи същността и правната рамка на ПЧП. Резултатът е, че все още няма изработено единно становище по въпроса. Търсят се обобщения, изхождайки от съгласуваните становища в материалите на Европейския съюз. Проблем в това отношение е, че те не са достатъчни за пълното прилагане на схемите за публично-частни партньорства, поради особеностите на националните законодателства на страните-членки, в т.ч. и България, и суверенното право на всяка страна да регламентира по собствен начин проблематиката.
