Atención en salud en la jurisprudencia constitucional. Análisis a partir de los derechos subjetivos

Abstract

La corte constitucional colombiana a través de sus sentencias de tutela ha desarrollado la dinámica del cumplimiento de la obligación del Estado frente a los usuarios del Sistema General de Seguridad Social en Salud (SGSSS) orientando, en cada categoría de sujeto en particular, según las necesidades que presentan, la forma en que deben ser atendidos, valorados y efectivamente protegidos ante la vulneración de su Derecho a la Salud por parte de los actores que dirigen el sistema. Este trabajo analiza el derecho a la salud desde dos sujetos especiales: los ninos y las mujeres embarazadas.
