El Tribunal Superior de Trabajo y el fenómeno de la tercerización en Brasil: notas de una investigación

Abstract

O artigo teve como objetivo analisar as decisoes do Poder Judiciário Trabalhista brasileiro envolvendo o fenomeno da terceirizacao, com foco nos acórdaos do Tribunal Superior do Trabalho (TST) entre 2000 e 2016 e em um diálogo com recentes decisoes do Supremo Tribunal Federal (STF), sobre o tema. Até 2017 nao havia no Brasil legislacao específica sobre a terceirizacao. Nesse vácuo, o TST, por meio de suas decisoes, estabeleceu parametros jurisprudenciais que acabaram sendo sumulados no decorrer do tempo, como é o caso da Súmula 331, de 1993, alterada posteriormente. Este texto analisa essa dinamica e, a partir dela, o papel da Justica do Trabalho e, mais recentemente, do STF diante do aprofundamento da terceirizacao para trabalhadores do setor papel e celulose, eletricitários, petroleiros, correspondentes bancários, trabalhadores em Call Center e Tecnologia da Informacao (TI) em bancos públicos.
