Elementos fundamentales del derecho y la economía: una aproximación al análisis institucional

Abstract

El artículo tiene como propósito resaltar el vínculo entre el derecho y la economía y su aplicación en los sistemas jurídicos internacionales. La forma bajo la cual se están realizando los acuerdos y las negociaciones en los tratados internacionales de comercio obligan a reconsiderar la importancia no sólo de actuar en derecho sino en economía. La manera como son presentados los casos jurídicos de las empresas muestran falta de claridad no solo legal sino económica, obligando a las empresas a recurrir a mecanismos diversos para proteger sus intereses. Ante esto, el análisis económico y del derecho, en conjunto, contribuyen a definir los criterios con que deben evaluar los sujetos económicos internacionales los temas de concesiones, contratación y propiedad internacional, mejorando la aplicación legal-económica en casos empresariales y estatales.
