Was wissen wir über den Effekt von Investitionsschutz- und -förderverträgen auf ausländische Direktinvestitionen?

Abstract

Investitionsschutz- und -förderverträge sind völkerrechtliche Abkommen zwischen zwei Staaten. Sie haben das Ziel, ausländische Direktinvestitionen zu fördern, indem sie die Rechtssicherheit für ausländische Investoren verbessern. Sie schützen Unternehmen der Signatarstaaten jeweils vor Enteignung, staatlicher Willkür und Diskriminierung und erlauben die Rechtsdurchsetzung außerhalb des Gerichtssystems des Ziellandes. Damit schränken sie den Handlungsspielraum der Länder ein. Führen diese Abkommen überhaupt zu zusätzlichen Direktinvestitionen? Dieser Artikel stellt die Ergebnisse einer Metastudie, die die existierende empirische Evidenz zusammenfasst, vor. Entgegen manchen Behauptungen findet die Literatur weitgehend positive Effekte. Im Durchschnitt führt ein Investitionsschutzvertrag zu einem Zuwachs der ausländischen Direktinvestitionen von ca. 25%.
