Ansätze zur zukünftigen Besteuerung der Renten aus der gesetzlichen Rentenversicherung

Abstract

Laut Bundesverfassungsgericht ist die unterschiedliche Besteuerung von Beamtenpensionen und Renten nicht mit dem Gleichheitssatz des Grundgesetzes vereinbar. Dieser Feststellung folgend stellt Prof. Dr. Eckart Bomsdorf, Universität zu Köln, zunächst Ansätze zur Steuerfreistellung der Arbeitnehmerfreibeträge zur gesetzlichen Rentenversicherung und anschließend Ansätze zur vollen Besteuerung der Renten vor. Eine vollständig systemadäquate Lösung, d.h. Steuerfreistellung in der Beitragsphase und Besteuerung in der Rentenphase, ist nur in einem sehr langen Zeitraum zu realisieren. Prof. Bomsdorf schlägt zwei Modelle vor, bei denen die Steuerfreistellung der Beiträge im Jahr 2005 beginnt und die Steuerpflicht der Renten im Jahr 2005 mit 50 bzw. mit 65% einsetzt und, differenziert nach Rentenbestand und Rentenzugang, innerhalb eines Zeitraums von 35 bzw. 40 Jahren bis auf 100% erhöht wird.
