Abstract

The law of August 2, 2021 establishes the assessment of occupational risks as a prerogative of occupational health services. However, this practice was already widely deployed, prescribed and formalised in the services in question. Based on a participant-observation carried out in one of these services, the purpose of this article is to analyze the rise of this practice. Firstly, it examines the way in which risk assessment has been imposed against the wishes of certain occupational physicians and despite the statutory independence which they enjoy in theory. Secondly, it explores how the development of this practice has led to a rationalization and commodification of prevention activities. Finally, the article analyses the deployment of this evaluation as an example of the managerialization of the law, which responds to demands for change in working conditions by satisfying the needs of the employer.
