‪Entre égalité de traitement et harcèlement, quel fondement juridique de la discrimination syndicale ?‪. État des lieux et analyse du contentieux entre 2012 et 2014

Abstract

?French Law has developed since 1956 an important amount of provisions aimed at fighting workplace anti-union discrimination, protecting members and representatives of trade unions. Whereas the legal provisions and case-law are well known, the judicial decisions have never been systematically studied. The present article presents a study of a representative sample of these proceedings. It appears that few workers get involved into such litigations, and that the issues are various. Furthermore, the study shows that these litigations are seldom separated from other topics such as harassment and equal treatment so that the particularities of these actions are diluting into a general frame protecting the worker as a person.?
