‪Les pratiques des employeurs en matière de rupture du CDI‪. Un nouveau regard sur les règles de protection de l’emploi

Abstract

This article deals with a microeconomic reassessment of how the employment protection legislation is actually used by employers. Focused on the separation rules of open-ended contracts (CDI), the aim of the article is to improve empirical understanding of the use of firings (both for economic reasons ? LME ? and for personal reasons ? LMP), resignations and mutual agreed terminations (RC). First, I show the difficulties and lacks of the current statistical data and next I propose a larger view of the use of CDI terminations in French firms with at least 10 employees. Then, my analysis shows a very weak use of economic firings, which has steadily decreased for almost three decades. Although there is a larger variation in the use of LMP over a long period, it has decreased since 2008 when the RC was introduced. This latter result may suggest eventual substitutions between these two types of terminations. By contrast, I find rather more complementary effects between the different types of CDI terminations.
