La libre circulation des personnes dans l'Union européenne : malheur aux immobiles ?

Abstract

Most European citizens opt for a sedentary lifestyle. Woe to them. European law on free movement of persons does not apply to situations purely internal to a State. Member States may treat their own nationals less favourably than other European citizens without being subject to the European Court of Justice?s censorship. In other words, European law ignores reverse discrimination. The aim of this article is to familiarize non-lawyers with that basic rule of European law, while illustrating its application in the Belgian context. Criticism the rule has received as well as its erosion resulting from the Court?s case law will also be examined.
