La résolution des conflits individuels du travail. Conciliation versus médiation

Abstract

Our aim is to present an economic analysis of the French legal process of resolution of personal labour conflicts. We address the question of whether the mediation would be a better procedure for resolving individual labour disputes than the obligatory phase of attempt at conciliation, which exists in France. The analysis falls under the line of the optimistic models. We argue that the mediation should be promoted since less trials occur when mediation is the alternative dispute resolution procedure instead of the obligatory conciliation.
