Abstract

The EC REACH regulation was enforced the 1st June 2007. REACH requires undertakings to prove the environmental and sanitary innocuousness of their chemical substances. The implementation of this regulation involves the production and exchange of a significant amount of technical and competitive information. This article aims to identify the potential anticompetitive effects at this stage. Firms could lead strategies of "information shortage", to foreclose their competitors to the efficient process of cost sharing. Firms could also lead strategies of "wealth of information", by entering into anticompetitive information exchanges or raising rival costs trough the choice of an over-optimal level of regulation costs.
