11. L’arbitre, juge de l’économie mondiale

Abstract

Arbitration has always existed, but globalization made it the natural judiciary organization of trade, and thus of the global economy. Every actor, states included, use arbitration. Not a single contract is signed, not a single foreign investment is foreseen, without reference to arbitration as the solution to litigation. Governed by multilateral international conventions ratified by more than 150 states, arbitration provides a neutral judge, who is not involved in local affairs. Even better, through its stable, efficient, and nationless system, arbitration both contributes to and regulates the development of the world economy.
