Abstract

In 2022, several notable decisions on cooperative law were made that relate to events from 2011 to 2020. This article presents the relevant decisions in detail and focuses in particular on the robustness of the reasons for the decision. With these decisions, some important legal questions of cooperative law are clarified (at least for the time being and in part): This primarily concerns the liability of cooperative auditing associations towards the members of the audited cooperative, and the admissibility of a quorum of signatures based on individual electoral districts in the election to the representative assembly as well as the obligation of members to pay outstanding contributions after the cooperative's insolvency with the gradual acquisition of the cooperative's shares.
