Abstract

The article outlines the decisions of the Administrative Court of Hannover and the Higher Administrative Court of Lüneburg mentioned at the beginning, which dealt with the admissibility of a municipality's participation in a district heating and broadband network cooperative under municipal constitutional law. After a brief presentation of the facts of the case and the court's reasoning, the decisions are subjected to a critical assessment on the basis of the classic methods of interpretation. In the concluding part, the special features resulting from the legal form of the registered cooperative are examined, especially in comparison to classic corporations.
