Vermieterpfandrecht und Zahlung des Mietzinses im Einzugsermächtigungsverfahren

Abstract

Obwohl das Einzugsermächtigungsverfahren des Lastschriftverkehrs seit 1964, und zwar mit großem Erfolg, praktiziert wird, ist nach wie vor höchstrichterlich nicht geklärt, unter welchen Voraussetzungen bei dieser Art der bargeldlosen Zahlung die Geldschuld im Valutaverhältnis zwischen Gläubiger und Schuldner durch Erfüllung erlischt (§362 Abs. 1 BGB). Die Auswirkungen der unterschiedlichen Rechtsvorstellungen im Schrifttum lassen sich anhand der interessanten Fallgestaltung im Urteil des Landgerichts Regensburg vom 5.8.1991 verdeutlichen.
