Haustürwiderrufsgesetz und Bürgschaft: Ein Beitrag zur causa „kausaler“ Sicherungsgeschäfte und zum europäischen Zivilrecht

Abstract

Der folgende Beitrag befaßt sich vordergründig mit der Anwendbarkeit des Haustürwiderrufsgesetzes auf die Bürgschaft; die Anwendbarkeit wird vom BGH bislang verneint. Dabei wird dieses Einstiegsproblem zum Anlaßfür eine genauere Analyse der Rechtsbeziehungen zwischen Sicherungsgeber und Sicherungsnehmern bei sogenannten kausalen Sicherungsgeschäften genommen und dient zum anderen als anschauliches Beispiel für die nach wie vor nicht ausreichend beachtete Bedeutung des europäischen Zivilrechts.
