Abstract

§609a BGB will den Schuldner vor hohen Zinsen schützen undräumt ihm ein Kündigungsrecht ein. Gebietskörperschaften können dieses Recht abbedingen, private Schuldner aber nicht. Kredite mit Kündigungsrecht haben einen höheren Effektivzins als Kredite ohne dieses Recht. Um diese Mehrbelastung unter realitätsnahen Annahmen zu berechnen, wird ein Optionsbewertungsmodell. für das Kündigungsrecht nach §609α BGB entwickelt.
