Praktische Folgerungen aus der Rechtsprechung zur „nachschüssigen Tilgungsverrechnung"

Abstract

Die Entscheidung des Bundesgerichtshofs vom 24.11.1988 zur sog. nachschüssigen Tilgungsverrechnung wurde im Realkreditgeschäfi mit Spannung erwartet, weil sie die Banken in einer hohen Zahl von laufenden, möglicherweise auch bereits abgewickelten Kreditgeschäften zu einer nachträglichen Umberechnung der Zins- und Tilgungsleistungen der Darlehensnehmer zwingen könnte. Erste Reaktionen aufdas Urteil gehen von einem weittragenden Sieg des Verbraucherschutzgedankens aus. In der Praxis ist zu hören, daß bei den betroffenen Banken und Bausparkassen Rückstellungen in zweistelligen Millionenbeträgen erwogen werden. Der Beitrag untersucht das Urteil auf seine praktischen Folgen bei der zukünftigen Handhabung dieses Kredittyps und versucht, erste Aspekte zur Fortentwicklung der Theorie der InhaltskontroUe von Α GB-Verträgen im Zuge des sog. Transparenzgebots zu formulieren
