Die Rückabwicklung rechtsgrundloser Zahlungen eines Bürgen

Abstract

Hat der Bürge dem Gläubiger gezahlt und stellt sich dann die Unwirksamheit der Hauptverbindlichkeit heraus, so steht der Rückforderungsanspruch nach Canaris dem Hauptschuldner zu. Diese Auffassung ist gewichtigen Einwänden ausgesetzt, doch vermag auch die herrschende Meinung, die dem Bürgen die Kondiktion zuspricht, nicht völlig zu überzeugen, insbesondere weil sie das Sicherungsbedüifhis des Gläubigers bei der Rückabwicklung vernachlässigt. Im folgenden wird versucht, durch Herausarbeitung der maßgebenden Kausalbeziehungen und Interessen zu einer befriedigenden Lösung zu gelangen
