Yerel Yönetimlerce Çıkarılan Yönetmeliklerin Yayım ve Kalite Sorunu

Abstract

Bu çalısmada doküman analizi yöntemiyle yerel yönetimlerce çıkarılan yönetmeliklerin yayım ve kalite sorunu ortaya konularak çözüm önerileri getirilmektedir. Yerel yönetimler Anayasa ve kendi kanunlarına istinaden vatandasların günlük hayatını etkileyen pek çok konuda yönetmelik çıkarma yetkisine sahiptir. Bunların güncel metinlerine vatandasların erisebilmesinin temini hukuk devletinin bir geregidir. Yerel yönetimlerce çıkarılan yönetmelikler Resmî Gazete’de degil yerel gazetelerde ve kurumsal internet sitelerinde yayımlanmaktadır. Ancak günümüz teknolojik imkânları dikkate alındıgında bu yöntemin yetersiz oldugu ve ihtiyacı karsılamadıgı görülmektedir. Hukuk devletinin bir unsuru olan hukuki belirlilik ilkesi dikkate alınarak ilgili mevzuat degistirilmelidir. Yerel yönetimlerce çıkarılan yönetmeliklerin güncel sürümlerinin internet üzerinden erisime açılması hukuki belirlilik ilkesi bakımından gereklidir. Türk hukuk sisteminde yönetmeliklerin hazırlanmasında kaliteyi temin etmek üzere biçim, içerik ve danısma süreçleri düzenlenmistir. Merkezi idarede mevzuat kalitesi Cumhurbaskanlıgı Hukuk ve Mevzuat Genel Müdürlügü tarafından gözetilmektedir. Fakat yerel yönetimlerce çıkarılan yönetmeliklerin kalitesi kendi örgütü dısındaki uzmanlar tarafından gözden geçirilmemektedir. Bu çalısmada, mevzuat kalitesini artırmak için yerel yönetimlerce çıkarılacak yönetmelik taslaklarına ön inceleme yapılması, hukuki belirliligi saglamak amacıyla yeni çıkarılan yönetmelikleri yayımlamak üzere Yerel Yönetimler Bülteni kurulması ile yürürlükteki yönetmelikleri tek metin haline getirerek yayımlayan Yerel Yönetimler Mevzuatı Bilgi Sistemi kurulması önerilmektedir.
