Resolution of banking crises: what are the loss absorbency requirements in Europe and the United States?

Abstract

Europe and the United States (US) have strengthened their capacity to cope with banking crises since the 2008 global financial crisis. The authorities have set up a method for managing bank failures, known as resolution, that safeguards financial stability and protects depositors. Resolution makes it possible to maintain the activities of a failing bank or transfer them to an acquiring entity, with financing provided through contributions from shareholders and creditors rather than taxpayers. To this end, the authorities require significant banks to issue capital and debt instruments capable of absorbing losses on financial markets, in compliance with the international standard on total loss absorbing capacity (TLAC). This article compares loss absorbing capacity requirements in Europe and the United States, and finds European standards to be more stringent than those in the US. Depuis la crise financière mondiale de 2008, l’Europe et les États-Unis ont renforcé leur capacité à faire face à des crises bancaires. Les autorités ont mis au point une méthode de gestion des défaillances bancaires, la résolution, pour préserver la stabilité financière et protéger les déposants. La résolution d’une banque défaillante permet d’organiser la continuité de ses activités ou leur cession à un acquéreur, en mettant à contribution les actionnaires et les créanciers plutôt que les contribuables. Pour ce faire, les autorités ont imposé aux établissements importants d’émettre sur les marchés financiers des instruments de fonds propres et de dette à même d’absorber des pertes, conformément à la norme internationale de capacité d’absorption des pertes (TLAC, total loss-absorbing capacity). Cet article compare les exigences de capacité d’absorption des pertes en Europe et aux États-Unis. Il en ressort que les normes européennes sont plus exigeantes en la matière que les normes américaines.
