[Le surendettement et les femmes]

Abstract

The overindebtedness procedure, which is aimed at finding solutions for households in financial difficulty, has been in existence for nearly 30 years. After initially rising in the 1990s and 2000s, the annual number of applications has fallen by 30% since 2014, thanks to legislation to curb abusive lending practices, and an improvement in household solvency stemming from low interest rates and loan renegotiations. The legal framework for assisting overindebted households, the methods of dealing with applications and even the goals of the procedure have all changed profoundly since the system was introduced, as has the profile of the applicants. In the 1990s, a large proportion of overindebted individuals had some financial resources but were struggling to repay too many loans, in particular consumer loans. Over the years, however, the procedure has increasingly become focused on the most financially vulnerable segments of society, in particular women raising children on their own. Le traitement du surendettement, visant à apporter des solutions aux ménages en difficulté financière, a presque trente ans. Le nombre de dossiers déposés, qui avait crû dans les années 1990 et 2000, a baissé de 30 % depuis 2014, grâce à la législation contre les pratiques excessives en matière de crédit et à l’amélioration de la solvabilité des ménages permise par la baisse des taux et les renégociations de crédit. Le cadre légal d’accompagnement des ménages surendettés, les modalités de traitement des dossiers et même les objectifs assignés à la procédure ont profondément évolué, tout comme le profil des surendettés. Dans la décennie 1990, la part des personnes surendettées non dépourvues de ressources mais confrontées à un excès de crédits, à la consommation en particulier, était élevée. Au fil des années, la procédure de surendettement s’est concentrée sur les personnes les plus fragiles financièrement, notamment les femmes seules avec enfants.
