Abstract

Postsocijcilističko bezakonje privuklo je ozbiljnu pažnju i dovelo do ninogo pogrešnog teoretisanja. U radu se kritikuju neke šire prihvaćene pogrešne predstave. Među njima je ignorisanje privatnog sprovođenja zakona, neuviđanje međuzavisnosti širine spektra prava koja imaju da se ostvare i troškova sprovođenja, pogrešno uverenje da je vladavina prava u osnovi stvar javnog izbora i davanje prednosti dministrativnih u odnosu na sudske lekove. Nakon što su odbačeni takvi pokušaji tumačenja, u radu se insistira da analiza treba da se usredsredi na druga pitanja. Sva su ona povezana sa socijalističkim nasleđem. Ta pitanja su degradiranje građanskog i ustavnog prava, nestabilnost pravnih pravila, nedovoljno izražena podela vlasti i vrlo specifični uzroci zakrčenosti sudova.
