Ka Novim Obrazovnim Prostorima - Komentar Prednacrta Zakona 0 Visokom Obrazovanju -

Abstract

Zakon o visokom obrazovanju je dugo očekivani pravni akt. Za njegovu pripremu tokom poslednje tri godine učinjeno je nekoliko neuspešnih pokušaja. Ti dosadašnji pokušaji bili su bezuspešni. Budući da je bio i ostaje stvar od najvišeg društvenog prioriteta, obnovljeni napor da se formuliše i kasnije izglasa ovaj Zakon pozdravljen je kao dobrodošlo i društveno korisno pregnuće. Pozdravljene su kao dobrodošle i glavne inovacije koje nudi ovaj zakon, a posebno njegova upadljiva usaglašenost sa Bolonjskom deklaracijom i drugim međunarodno plasiranim i prihvaćenim dokumentima. Prednacrt pomno sledi međunarodne dokumente kojima se trasiraju putevi budućeg razvoja obrazovnih sistema evropskih zemaIja i obezbeđuje njihova uzajamna kompatibilnost. Čini se da je Prednacrt opterećen starim uklonom ka preteranoj i potencijalno pogibeljnoj centralizaciji, što drastično smanjuje kapacitet sistema u donošenju odluka. Tretman vlasništva nad imovinom fakulteta ocenjen je kao nekonzistentan i pravno neutemeljen. Neusaglašenost se otkriva i u jednom broju nadležnosti koje univerzitet ima u odnosu n afakultete i, obrnuto, u ovlašćenjima fakulteta prema univerzitetu.
