Evaluando las compras excluidas de la Ley de Contrataciones del Estado

Abstract

En el año 2014, las compras excluidas de la ley de contrataciones del estado totalizaban 2 mil millones de soles, un poco menos del 5% del total de compras reportado por OSCE. Con el transcurso de los años y debido al incremento del límite de 3 UITS a 8 UITS en 2016 y al posterior al aumento temporal a 9 UITs en 2022, estas crecieron exponencialmente, y en el 2022 superaron los 13.6 mil millones de soles (20% del total de compras reportadas por el OSCE. En ese sentido, la presente investigación busca realizar un primer análisis de las compras excluidas de la LCE en el Perú, enfocándonos en las compras de bienes, cuantificando la aglomeración de contratos y caracterizar lo que ocurre alrededor del umbral de las compras menores usando datos a nivel de contrato. Investigación ganadora del XXVI Concurso Anual de Investigación CIES 2022 – II, con la cooperación del Ministerio de Economía y Finanzas (MEF), en el marco de la Ley de Presupuesto del Sector Público para el año fiscal 2022 (Ley N° 31365) que dispone una subvención al CIES para el desarrollo de evaluaciones y otros estudios relevantes para la mejora de las políticas públicas, cuya aprobación fue formalizada mediante la Resolución Ministerial N° 144-2022-EF/43.
