The Subjective Side of Mass Disorder Offences

Abstract

Mass disturbances constitute a negative social phenomenon that poses a great danger to society. Human behavior is generated exclusively by emotions, feelings, experiences, as well as reactions to the environment. All this constitutes the sphere of the psychophysics, which is composed of the cohesion between reasoning and the physical factor. It follows from this that the legal conduct is practically formed like the criminal one, having in itself objective and subjective components. They appear both in connection with demonstrations, protests and during the organization of other events. The purpose of this paper is to highlight and describe the legal elements of the subjective side of the offence of mass disorder to the extent that they can generate antagonistic situations in the process of legal classification of offences. However, the reasons for committing the analyzed offence may be similar to the reasons for committing other offences.
