Analiza măsurilor de protecție a proprietății intelectuale prin prisma proiectului Codului Vamal

Abstract

Reglementarea unui sistem echilibrat de protecție a proprietății intelectuale la frontieră re-prezintă o necesitate imperioasă întrucât va produ-ce efecte benefice atât pentru mediul privat, cât și pentru stat și societate în ansamblu. Impactul pozi-tiv al acestor reglementări constă în următoarele: a) titularii drepturilor de proprietate intelectuală (me-diul privat) vor beneficia de măsuri de protecție la frontieră pentru a-și proteja drepturile prevăzute de legislația de specialitate și garantate de Constituție; b) autoritățile vamale vor dispune de instrumenta-rul necesar în vederea contracarării acțiunilor ilega-le de introducere în țară a mărfurilor contrafăcute și piratate; c) populația Republicii Moldova va fi pro-tejată de accesul pe piața internă a mărfurilor ne-calitative, neconforme și periculoase pentru viața și sănătatea lor.
