Analiza juridică a actului de concurenţă neloială săvârșit prin copierea ilegală a formei, a ambalajului sau a aspectului exterior al produsului unei întreprinderi

Abstract

Autorul scoate în evidenţă actele de concurenţă neloială și supune analizei acţiunile necinstite ale unui agent economic care constituie fapte ce sunt de natură să creeze, prin orice mijloc, o confuzie cu întreprinderea, produsele sau activitatea industrială sau comercială a unui concurent. Astfel de practici neoneste au făcut obiectul diverselor analize economice și ju-ridice care au demonstrat efectul negativ al actelor de concurenţă neloială asupra economiei. Soluţiile juridice corecte pe marginea acestor cazuri conduc cu certitudine la instaurarea unei practici judiciare constante care nu va admite emiterea unor hotărâri ambigue în materia actelor de concurenţă neloială.
