Unele consideraţii privind conflictul dintre marcă și un nume de domeniu identic sau similar

Abstract

Autorul scoate în evidenţă fenomenul încălcării drepturilor asupra mărcii prin înregistrarea unor nume de domeniu similare sau identice cu o marcă deţinută de o persoană terţă, cunoscut ca piraterie cibernetică sau cybersquatting. Un mecanism eficient de combatere a acestui fenomen este Politica de Rezolvare Uniformă a Disputelor promovată de Corporaţia de Atribuire a Numelor și Numerelor în Internet și Organizaţia Mondială a Proprietăţii Intelectuale, care prevede proceduri administrative și măsuri împotriva pirateriei cibernetice. Litigiile dintre numele de domeniu și marcă pot fi soluţionate de asemenea prin intermediul instanţelor naţionale de judecată.
