Analiza răspunderii penale pentru concurenţa neloială (art. 246/1 Cod penal)

Abstract

În acest studiu se efectuează analiza juridică a situaţiei pieţei şi a raporturilor economice cu delimitarea cazurilor de concurenţă loială/licită de cazurile de concurenţă neloială (monopol, oligopol, monopson, oligop-son) şi acţiunile anticoncurenţă, precum și, de asemenea, calificarea situaţională în corespundere cu legislaţia în vigoare, în special răspunderea penală prevăzută la art.246/1 Cod penal al R.M. Mediul concurenţial poate fi afectat negativ de activităţile anticoncurenţiale care reprezintă obiectul sau efectul înţelegerilor sau a practicilor concertate între agenţii economici, de abuzul de poziţie dominantă a unor agenţi economici puternici; de asemenea, concurenţa poate fi distorsionată prin subvenţiile acordate de stat unor agenţi economici, ceea ce le creează o poziţie avantajoasă faţă de ceilalţi concurenţi pe piaţa respectivă.
