Reflecţii cu privire la oportunitatea anulării derogării stabilite în alin.(1) art.77 al Legii concurenţei

Abstract

În articol sunt examinate o serie de speţe privind comiterea unor acte de concurenţă neloială și aplicarea răspunderii în conformitate cu art.2461 din Codul penal al Republicii Moldova sau în baza art.77 alin.(1) al Legii concurenţei (nr.183 din 11.07.2012). Interpretând sistemic prevederile alin.(1) art.2 și art.2461 CP RM, precum și ale alin.(3) art.9 din Constituţie, autorul concluzionează că concurenţa loială constituie valoarea socială specifică (derivată din economia naţională, privită ca valoare socială fundamentală), care este susceptibilă de ocrotirea oferită de art.2461 din Capitolul X „Infracţiuni economice” al părţii speciale a Codului penal, pe când alin.(1) art.77 al Legii concurenţei nu poate oferi o asemenea protecţie. În concluzie, autorul propune ca această normă să fie exclusă din Legea concurenţei
