Aspecte privind protecţia juridică a soiurilor noi de plante

Abstract

Un soi nou poate fi protejat prin secret comercial (know-how). El este prezentat, obiectiv, prin seminţe sau alte organe de înmulţire, însoţite de „documente confidenţiale” - descrierea soiului, recomandări de cultivare şi păstrare ș.a.m.d. Soiul nou, odată ameliorat, nu poate fi pur şi simplu păstrat, el trebuie „menţinut”, în special caracterele lui calitative şi cantitative. Însă modul de înregistrare a soiurilor noi, care are un caracter public, supravegherea oficială a culturilor semincere nu sunt în concordanţă cu sistemul de menţinere a soiului în regim de know-how. Din aceste considerente, protejarea soiului nou prin dreptul de brevet de soi de plantă sau în regim know-how este prioritatea posesorului dreptului exclusiv.
