Este tatuajul obiect al dreptului de autor?

Abstract

Autorul analizează tatuajul ca obiect al proprietăţii intelectuale, subliniind că existenţa unui contract privind transmiterea drepturilor patrimoniale asupra operei, încheiat între autor și beneficiarul tatuajului, ar exclude în mare problemele care ar putea să apară în acest sens. Este scoasă în evidenţă ideea că tatuajul este obiect al dreptului de autor și, în același timp, o excepţie a drepturilor morale de autor atunci când autorul este lipsit de câteva drepturi morale – dreptul la respectarea integrităţii operei, dreptul la divulgarea operei și dreptul la retractarea operei, care trec în exercitarea persoanei căreia i-a fost aplicat tatuajul.
