Anularea mărcii din motivul înregistrării cu rea-credinţă

Abstract

În condiţiile unei concurenţe de piaţă tot mai înverșunate, companiile se confruntă în mod frecvent cu situaţii în care mărcile lor sunt folosite şi/sau înregistrate de către terţe persoane în state/jurisdicţii în care companiile respective nu au o înregistrare anterioară. În majoritatea statelor lumii este posibilă opoziţia faţă de o asemenea folosinţă/înregistrare, dacă rea-credinţa poate fi dovedită, însă întrunirea criteriilor de probă prezintă mari dificultăţi. Procedura anulării pe temei de rea-credinţă este reglementată de prevederile unui șir de legi internaţionale și naţionale. În acest sens, autoarea articolului prezintă câteva cazuri concrete din practica judiciară a Republicii Moldova.
