Transfer de tehnologie și norme concurențiale

Abstract

Transferul de tehnologie constituie o modalitate esențială de diseminare a beneficiilor generate de proprietatea intelectuală. Însă acest proces poate fi folosit drept obstacol pentru crearea produselor inovative și intrarea lor pe piață. Normele concurențiale privind acordurile de transfer de tehnologie sunt menite să servească prevenirii și rezolvării problemelor ce stau în calea inovării. Obiectul prezentului articol îl constituie evaluarea acordurilor de transfer de tehnologie din punctul de vedere al cerințelor stabilite de legislația concurențială națională, precum și abordarea necesității modificării acesteia prin prisma adaptării la acquisul comunitar în domeniu. De asemenea, se va expune poziția în ceea ce privește considerarea normelor concurențiale aferente acordurilor de transfer de tehnologie în cadrul managementului proprietății intelectuale.
