Aspecte privind interferența dintre marcă și dreptul de autor

Abstract

Protecția proprietății intelectuale presupune exercitarea unor drepturi exclusive asupra acesteia, asigurându-i titularului condițiile necesare de activitate în virtutea legii. Interferența dintre obiectele proprietății intelectuale este una inevitabilă, așa încât titularii de drepturi exclusive sunt nevoiți să găsească o cale de a coexista pe piață fără a aduce prejudicii unul altuia. Autorii materialului au scos în evidență esența drepturilor asupra mărcii și a drepturilor de autor, relevând, cu exemple concrete, practica națională și internațională privind suprapunerea acestora.
