Infracţiunea de încălcare a dreptului de autor şi a drepturilor conexe din perspectiva unor modificări legislative

Abstract

În prezentul articol autorii nuanţează anumite soluţii de perfecţionare a cadrului normativ dedicat incriminării infracţiunii de încălcare a dreptului de autor și a drepturilor conexe prevăzute la art. 1851 Cod penal (CP) al Republicii Moldova. Analiza infracţiunii de încălcare a dreptului de autor și a drepturilor conexe este realizată prin prisma metodei prospective de studiere a dreptului penal. În acest sens, au fost analizate prevederile referitoare la domeniul protejării proprietăţii intelectuale din legislaţia naţională, precum și din cea a altor state.
