Particularitățile formelor de realizare a dreptului de petiționare

Abstract

Autorul supune analizei formele de exercitare a dreptului de petiţionare care reprezintă un complex de proceduri reglementate de lege, îndreptate spre realizarea prerogativelor care le revin în acest sens, pe de o parte, organelor de stat și persoanelor cu funcții de răspundere și, pe de altă parte, cetăţenilor și organizaţiilor. Concluzia desprinsă din acest studiu este următoarea: poate fi considerat democratic doar statul în care puterea supremă aparţine poporului, iar toate instituțiile statului lucrează în beneficiul poporului și se află sub controlul său exclusiv. Aceasta poate avea loc doar dacă cetățenilor li se respectă în totalitate libertăţile și drepturile fundamentale. Unul dintre aceste drepturi este dreptul de petiţionare executat prin formele lui expuse în materialul de față
