Cadrul normativ de reglementare și perspectivele de dezvoltare a parteneriatului public-privat în sfera proprietății intelectuale

Abstract

Parteneriatul public-privat este unul din instrumentele prin care autoritățile publice gestionează patrimoniul public, finanțele publice și organizează prestarea de servicii publice. Acest parteneriat nu prezintă o simplă convenție care se consumă la momentul încheierii (semnării) acesteia, ci, de regulă, îmbracă forma unor contracte administrative care durează în timp, cum ar fi : contractul de concesiune, de delegare a gestiunii, de achiziții publice ș.a. Deoarece în legislația și în practica Republicii Moldova parteneriatul public-privat este un fenomen nou, respectiv, implementarea acestuia nu este lipsită de unele erori și interpretări neadecvate, iar uneori chiar exagerate. În urma unei analize juridice a parteneriatului public-privat, autorul își propune să elucideze dacă acesta poate avea sau nu ca obiect și proprietatea intelectuală.
